DUTIES TO PREVENT FIRES
Fire Safety affects the entire community and Council
encourages property owners to be proactive in managing
the risk on their property.
Pursuant to Section 105F of the Fire and Emergency
Services Act 2005, the owner of land is required to protect
property on the land from fire, or to prevent, or inhibit the
outbreak of fire on the land, or through the land:
Section 105F requires that an owner of private land must
take reasonable steps
a. to prevent or inhibit the outbreak on the land;
b. to prevent or inhibit the spread of fire through the

d. to minimise the threat to human life from a fire on

hectares, to a maximum height of 10cms over the
entire block during the fire danger season.

metres wide, as near as practical to the perimeter of
the allotment and all undergrowth within 20 metres of
a dwelling during the fire danger season.
• In the case of dis-used horticultural properties, all
under growth should be maintained to 10cms and
provide a 20 metre buffer zone which may include,
removing dead trees against roadside and dwellings.
Council Fire Prevention Officers will commence property
inspections as of 13 October 2014 and notices pursuant to
section 105F of the Fire and Emergency Services Act will be
issued to non-complaint properties.
The maximum penalty for non-compliant with conditions
of a notice is $10,000 and Council may engage a contractor
to carry out the works, debting all reasonable costs to the
